If you are a driver or passenger of a vehicle involved in a collision with an Uber or a Lyft driver, you need to obtain the Uber or Lyft driver’s personal insurance information and his or her ridesharing information. The question of which of those two policies covers your damages depends on what “phase” of the job the Uber or Lyft driver was performing at the time of the motor vehicle accident. Because Uber and Lyft’s insurance policies do not cover all situations, we may be required to file a claim against the Uber or Lyft driver’s personal insurance. Uber and Lyft separate their insurance coverage into three distinct time periods as follows.

• First Phase. This phase applies if an Uber or Lyft driver is offline. If the Uber or Lyft driver is offline, he or she is solely covered by his or her personal insurance policy.
• Second Phase. This phase applies if an Uber or Lyft driver is online and waiting to pick up a passenger. If an Uber or Lyft driver is involved in a motor vehicle accident while he or she is online and waiting to pick up a passenger, Uber or Lyft’s insurance policy provides coverage. In that case, Uber and Lyft’s insurance provides 50/100/25 liability coverage. That means that Uber and Lyft’s insurance companies will cover up to $50,000 per person and $100,000 per accident for bodily injuries; and $25,000 for property damages.
• Third Phase. This phase applies when an Uber or Lyft driver has accepted a fare through the Uber or Lyft app and is en route to pick up the passenger or has already picked up the passenger and is en route to the passenger’s destination. As a result, from the moment that an Uber or Lyft driver receives a ride request to the time that he or she drops off the passenger, Uber and Lyft offer $1 million in liability, uninsured, and underinsured coverage.
